Eluding a police vehicle happens when a motorist willfully fails or refuses to immediately bring their vehicle to a stop and continues driving the vehicle in a reckless manner while attempting to elude a pursuing police vehicle after being given a visual or audible signal from a uniformed police officer to stop the vehicle. Attempting to Elude is a Class C felony punishable up to 5 years prison and a $10,000.00 fine.

Defenses

Fortunately, Alexander has obtained dismissals and reductions for clients charged with Attempting to Elude a Pursuing Police Vehicle. For example, it is an affirmative defense that a reasonable person would not believe that the signal to stop was given by a police officer and that driving after the signal to stop was reasonable under the circumstances.
